Non-EU nationals can work in Greece for the period of 90 days without work permit as long as they have a work and residence permit in another EU country
We would like to inform you on the following concerning the work authorization of the foreign (NON-EU) nationals, holders of a valid work and residence permit in another EU member state.
What stands so far:
-up to now, based on EU and national law, NON-EU nationals coming to Greece for work should obtain a specific work authorization/ national visa affixed to their passports before the commencement of any productive work in country.
-due to conflict between EU and national law, the duration of such visas can not be less than 3 months
-Greek Consulates are issuing the said visas with validity exceeding the 3-month duration even if the applicant wishes to stay for a lesser period
What stands from now on:
Further to the above and based on recent developments concerning the Declaration of Posting (already in force in almost all of the EU member states- Directive 2014/67), experience has shown that:
NON- EU nationals can come to Greece for productive work for the maximum period of 3 months without the need of an additional immigration document as long as:
-duration of the posting does not exceed the period of 90 days
-they are holders of a valid work and residence permit in another EU country
-declaration the posting takes place in the Greek competent Labor inspectorate department prior to commencement of work (proof of stay)
RED FLAG: please note that the above information is confirmed verbally by the Ministry of Foreign Affaires in Greece and the European Commission. The Ministry of Migration in Greece does not agree and we have filed a written request for this currently waiting for the reply.
